Avis Direct Terms and Conditions

Welcome to www.avisdirect.com, a used car program exclusively for licensed dealers. By voluntarily proceeding with a purchase via this website, you agree, for yourself, your dealership, your company, and your representatives (collectively, "you" or "PURCHASER"), to abide by the following terms and conditions of www.avisdirect.com as amended from time to time.

1. General

By continuing to purchase, invoice and fund purchases, you accept all of the policies, terms and conditions and acknowledge and agree that such terms and conditions will govern each Avis Direct sale transaction you engage in which will be enforceable against by either party against the other like any written negotiated agreement. Avis Car Sales, LLC or its affiliates or subsidiaries (hereafter referred to as the SELLER), and PURCHASER agree to abide by all policies, which are incorporated herein, and all policy decisions of SELLER. Any requested purchase price adjustments or vehicle rejections must be made prior to the sale of each purchased vehicle which is deemed to have occurred when the purchase is funded.

2. You affirm you are a Licensed Dealer

All transactions on this website are only for pre-registered and pre-approved licensed motor vehicle dealers.

3. Vehicle Condition Terms

In Service Sales- SELLER's Vehicle prep guidelines for "In Service Sales", include all "Safety Items" in working order. Safety Items shall mean airbags, seatbelts, headlamps, tail lamps, turn signals, brake lights, and collision avoidance features. No damaged glass. Tires at 4/32's or better at lowest point in tread, match by axle on RWD and FWD vehicles, all 4 will match on AWD and 4WD vehicles. No structural damage at the time of sale as such is defined by NAAA Guidelines as amended from time to time. No branded titles. All equipment functioning as designed. Vehicles are represented as $400 from wholesale ready and may have minor dents, scratches, cosmetic blemishes, scrapes, etc. and other signs of normal use. No arbitration claims under $400 will be considered for reimbursement. An "In Service Sales" means a vehicle that has not been posted on Avis Direct but has been requested by Purchaser.

4. Average Wear and Tear

PURCHASER, as a licensed motor vehicle dealer, understand that all Vehicles on www.avisdirect.com are used. As such, used Vehicle(s) may have minor dents, scratches, cosmetic blemishes, scrapes, etc. and other signs of normal use and are not subject to arbitration claims under $400 ("Wear and Tear"). PURCHASER EXPRESSLY agrees to waive any claim for purchase price adjustment on Wear and Tear claims under $400. If upon your receipt of these vehicle(s), you find Wear and Tear damage above and beyond the $400 threshold, please notify SELLER within 12 business days from release date, the discrepancies should be directed to the Arbitration section of Avis Direct. SELLER will make every attempt to reasonably rectifying the problem provided, however, only the claim shall only be considered above $400. By way of example, a substantiated claim of $450 for Wear and Tear shall only result in a purchase price adjustment of $50. Should no notification be received by SELLER within 10 days of release, all Wear and Tear claims or any other claim related to the condition of any purchased Vehicle shall be waived.

Wearable Items expressly excluded from post sale claims: Vehicles are not eligible for dispute for wearable items. Wearable items are defined as parts of the vehicle that the manufacturer recognizes need for replacement/adjustment during the expected life of the vehicle. These items are normally identified in the Owner's Manual for routine check and replacement and would include, but not limited to: tires, wipers, brake pads, shoes, rotors, belts, hoses, lubricants/fluids, timing belts, bulbs, filters, shocks & struts.

No dispute will be considered on noises or conditions that are inherent or typical to a particular model or manufacturer, unless deemed "excessive" by SELLER on non-warranty items. Manufacturer warranty guidelines will be used where applicable to determine whether the condition is excessive.

5. Payment

PURCHASER agrees to initiate payment to SELLER within 2 business days.

Wire/ACH to Avis Budget Car Rental, LLC. 6 Sylvan Way, Parsippany, NJ 07054, Bank of New York C/O Aesop Leasing/PV Holding Corp. Account #8900511907/ABA #021000018.

Floor Plan Funding, SELLER will initiate request of funds with PURCHASERs Floor Plan Provider.

Company Checks, with pre-approval by SELLER, PURCHASER will overnight to Avis Budget Group-Fleet Deletions, 300 Centre Pointe Blvd. Virginia Beach, VA, 23462 Phone 757-687-2445.

After receipt of payment, SELLER will transfer good and marketable titles to be free of all liens and encumbrances within 3 business days.

The Vehicle(s) must be paid for within 5 business days of the day of purchase or this sale may be considered null and void at SELLER discretion, unless other arrangements have been made in advance.

6. Release

SELLER will authorize shipment and release of the purchased vehicle(s) upon receipt of the executed Bill of Sale and receipt of funds.

SELLER and PURCHASER each agree that should any vehicle be left on SELLER premises for a period in excess of seven days, PURCHASER may be subject to a reasonable daily storage fee of $10 per day. Unless expressly agreed to the contrary in a writing signed by us, we are not a bailee of any purchased vehicle. You are solely responsible for any and all damage, theft, or loss relating to such property, including any damage caused by weather conditions except to the extent caused by the gross negligence or willful misconduct of Seller.

7. Purchaser's Responsibilities

The PURCHASER or PURCHASER's agent (transporter or driver) should note any obvious damage on the gate release prior to removing the vehicle from the pickup location. SELLER will not be responsible for any obvious damage not identified on the gate release or the condition report once the vehicle is removed from the pickup location. If PURCHASER's agent picks up the vehicle, PURCHASER will inspect the vehicle immediately upon arrival at PURCHASER's location and notify SELLER immediately of any discrepancies within the time frame as stated in this policy. PURCHASER will verify odometer reading upon arrival at PURCHASER's location. Mileage must be the same as when purchased if claiming for inoperable odometer. Discrepancies should be directed to the Arbitration section of Avis Direct.

SELLER will not arbitrate items that are eligible to be covered under manufacturer warranty. No dispute can be based upon information listed in Electronic Data Vehicle Histories ("EDVH") (i.e. Carfax, AutoCheck, etc.). It is the responsibility of PURCHASER to obtain any desired EDVH reports prior to purchase.

8. Trucking

SELLER will agree to trucking referred by PURCHASER, which will be referred to as PURCHASER's agent. PURCHASER agrees to hold SELLER harmless for any Transportation Damages. PURCHASER's agent will note any obvious damage on the gate release prior to removing the vehicle from the pickup location.

9. Accuracy of Information

Typographical and technology errors or glitches can occur despite our best efforts, which could cause errors in our pricing or disclosure of vehicle trim levels or equipment, are unintentional. In the event that such an error occurs on a vehicle you intend to buy or have purchased, the sale will be canceled and made available to you for the correct price. If you decline to purchase the car at the correct price, any amounts that have been paid by you for the purchase of the vehicle will be refunded.

10. Arbitration Process / Resolution Guidelines

Arbitration claims should be directed to the Arbitration section of the Avis Direct site

Defects, conditions, and discrepancies beyond minor dents, scratches, cosmetic blemishes, scrapes, etc. and other signs of normal use that were not disclosed, in excess of $400, may be submitted by the PURCHASER through the Arbitration section of the Avis Direct site, provided that PURCHASER has picked up the vehicle and submitted the dispute on a timely basis. In order for an Arbitration to be considered, the defects, conditions, or discrepancies must be listed in the Arbitration section of Avis Direct no more than 12 business days from release date for the vehicle. Pictures and repair estimates must be provided within 5 business days following submission of the arbitration by uploading the documents in the Arbitration section of Avis Direct. If not received timely, the arbitration will be closed.

If a price adjustment between SELLER and PURCHASER is offered and accepted, vehicle becomes "AS-IS" property of the PURCHASER, and is not subject to any further claim or adjustment.

If SELLER agrees to accept the return of the vehicle, the vehicle along with its properly endorsed title must be returned to SELLER at the original pick up location or another agreed upon location in the same or better condition than when purchased. A vehicle is not considered returned until received, inspected, and approved for return by SELLER
